GENERAL TERMS AND CONDITIONS OF THE STORE

The ZIA DIONE website contains an online store that operates in accordance with the Consumer Protection Act. When registering in the system, the visitor obtains a username and password, which can be used to access their account (My Account) or gain the right to make purchases during each visit to the website. The username and password unambiguously identify the user and connect them to the entered data. The General Terms and Conditions deal with the operation of the online store, user rights, and the business relationship between the owner of the online store, product suppliers, and the consumer.


PRICES AND DATA ACCURACY

All prices are in EUR and include the prescribed VAT. Prices are valid until new prices are published or changes are made to the shipping options on the ZIA DIONE website. The provider strives to ensure the accuracy and correctness of the data provided online. However, product characteristics, delivery times, and prices may change, and there is a possibility that the provider may not be able to simultaneously update the website with the changes. In such cases, the customer will be informed of the changes and will have the option to cancel or exchange the ordered item. If the price of an item changes during order processing, the provider will notify the customer. The provider will do its best to offer a lower price or provide an appropriate solution that satisfies both parties. Shipping is done within the agreed timeframe via a reliable postal service.


ORDERING

Ordering is available online 24/7, year-round. The consumer selects and orders products available in the online store, categorized by sections. After placing an order, the customer receives an email confirmation listing the products and quantities selected. Detailed information about the order’s status and content is always available in the “My Account” section. For any order changes or cancellations, the customer must notify the provider via email, stating the purchase number mentioned in the order confirmation. The provider will discreetly package and ship the goods within the promised timeframe and notify the customer by email with details about the return policy, delivery delays, and complaints.

The company commits to protecting customer data and using it exclusively for processing purchases. Customer data is protected in accordance with the Personal Data Protection Act and the General Data Protection Regulation (GDPR) (if applicable) and will not be disclosed to third parties. Registration and entry of personal data is required for the proper execution of online store services.

RIGHT TO WITHDRAW FROM PURCHASE, RETURN OF GOODS

The customer has the right to inform the company within 14 days of receiving the goods that they are withdrawing from the purchase, without having to state a reason for their decision. The notification is considered timely if it is sent within the deadline. The only cost that burdens the customer regarding the withdrawal is the direct cost of returning the goods. The latter must be returned to the company no later than 14 days after the notification of withdrawal. If the customer has withdrawn from the purchase, the company must return all payments made. The company must make the refund as soon as possible, but no later than 14 days after receiving the withdrawal notice. If the company is late with the refund, it must pay the customer legal late interest plus 1/10 of the payments received for each completed 30 days of delay in the refund. In case of returning an item, the customer must adequately protect the item before handing it over to the carrier. The item must be protected with the original packaging or packaging that can protect the item as well as the original packaging. Shipping costs are always paid by the sender, unless otherwise agreed in advance. We do not accept cash on delivery shipments.

The customer does not have the right to withdraw from the contract in the following cases:

  • For goods that are made according to the consumer’s exact instructions and tailored to their personal needs, such as customized or made-to-order items.


PAYMENT METHODS

In the online store, the provider enables payment exclusively via online payment methods, which are processed through secure payment gateways. Payments are handled using SSL encryption technology to ensure the security of your sensitive information. The purchase contract (order) is stored electronically on the website operator’s server and is accessible to the customer 24 hours a day in their “My Account” section.


DEFECTS AND WARRANTY

The seller is liable for defects in the goods in accordance with the provisions of the Obligations Code and the Consumer Protection Act. The seller is liable for material defects in the goods that appear within two years from the receipt of the goods, or within one year for used goods, as outlined in the Consumer Protection Act. The consumer may assert their rights on the basis of a material defect if they notify the seller of the defect within two months from the day the defect was discovered. The consumer must describe the defect in detail and allow the seller to inspect the item. The consumer can inform the seller about the defect in person, for which the seller must issue a confirmation, or send it to the store where the goods were purchased, or to the seller’s representative with whom they concluded the contract. The seller is not liable for material defects in the goods that appear after two years from delivery. It is considered that the defect in the goods already existed at the time of delivery if it appears within six months from delivery. If the existence of a defect in the goods or irregularity in the service provided is not disputed, the company must comply with the consumer’s request from Articles 37.c and 38 of the Consumer Protection Act as soon as possible, but no later than within eight days. The company must respond in writing to the consumer’s request no later than eight days after receiving it, if the existence of a defect in the goods or irregularity in the service provided is disputed.


COMPLAINTS AND DISPUTES

The provider respects the valid legislation on consumer protection. The provider makes every effort to fulfill its duty to establish an effective complaint handling system and to designate a person with whom the customer can connect by telephone or email in case of problems. Complaints are submitted via the email address contact@ziadione.com. The complaint handling procedure is confidential. The provider is aware that the essential characteristic of a consumer dispute, at least as far as judicial resolution is concerned, is its disproportionality between the economic value of the claim and the costs incurred in resolving the dispute itself. This is also the main obstacle preventing the consumer from initiating a dispute before a court. Therefore, the provider makes its best efforts to resolve any disputes amicably.

The customer can also file a complaint through the Online Consumer Dispute Resolution platform.


OUT-OF-COURT DISPUTE RESOLUTION

The owner of the ZIA DIONE website ensures the protection of personal data, which will be used exclusively for the purposes of informing about the progress of the order (if the visitor makes a purchase in the online store) and sending advertising material. The owner guarantees that visitor and user data will be used only for the purpose of smooth order processing and will not be transferred to a third party. In case of problems or ambiguities when using the website, the website owner reserves the right to contact the consumer through means of distance communication. By registering, the visitor allows the website owner to collect and use the personal data they enter during registration. All data that the visitor provides during registration are intended only for the provider’s business and are not forwarded for other purposes or to third parties. We permanently store the data that the visitor entered during registration in a computer system, which is adequately protected and secured. In case of a “breach” into the computer system, we bear no responsibility!
